ARTICLE 1 – PURPOSE
These General Terms and Conditions of Sale (hereinafter “GTC”) aim to define the rights and obligations of the company BOBINES and any natural or legal person making a purchase via the website (hereinafter “the Customer”), within the framework of the online sale of products offered by BOBINES.
These GTC notably specify the conditions for ordering, payment, delivery, and handling of any returns of products ordered by the Customer.
They apply, without restriction or reservation, to all sales concluded by BOBINES with Customers via its website.
The Customer declares to have read these GTC and accepted them without reservation before validating their order. Validation of the order therefore implies full and complete acceptance of these GTC.
These GTC are accessible at any time on the BOBINES website and prevail, if applicable, over any other version or any other contradictory document.
BOBINES reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.

ARTICLE 2 – PRICES
Prices are indicated in euros (€) all taxes included (TTC), including value-added tax (VAT) at the rate applicable on the day of the order.
BOBINES reserves the right to modify its prices at any time. However, products are invoiced based on the rates in force at the time of order validation.
The total amount due by the customer is indicated before the final validation of the order.
Prices are valid within the limits of available stock.
An invoice is issued and given to the customer upon validation of the order.

ARTICLE 3 – ORDER
Any order placed on the BOBINES site implies full and complete acceptance of these general terms and conditions of sale.
The customer undertakes to provide accurate, complete, and up-to-date information when ordering. BOBINES cannot be held responsible for entry errors and their consequences, particularly concerning delivery.
The ordering process includes the following steps: product selection, basket validation, entry of delivery and payment information, then order confirmation.
The order is considered definitive after payment validation and receipt by the customer of a confirmation email from BOBINES.
BOBINES reserves the right to refuse or cancel any order in case of dispute with the customer, non-payment, incorrect information, or suspicion of fraud.
In case of unavailability of a product after order validation, the customer will be informed as soon as possible and fully refunded the amounts paid.

ARTICLE 4 – PAYMENT
Payment is due in full at the time of order validation.
Payments are made by credit card via a secure payment platform. Payment information is encrypted and not retained by BOBINES.
The order will only be considered definitive after payment validation by the banking organization.
BOBINES reserves the right to refuse or cancel any order in case of refusal of payment authorization, an existing dispute with the customer, or suspicion of fraud.
In case of payment refused by the banking institution, the order will be automatically canceled.
The customer guarantees to BOBINES that they have the necessary authorizations to use the chosen payment method.

ARTICLE 5 – DELIVERY
Products are delivered to the delivery address indicated by the customer when ordering.
BOBINES undertakes to ship products as soon as possible. Delivery times are indicative and may vary depending on the carrier and destination.
In accordance with legal provisions, BOBINES remains responsible for the proper execution of delivery until the package is handed over to the customer.
In case of late delivery, the customer may contact BOBINES to obtain information on the routing of their order.
The customer is required to check the condition of the package and products upon receipt. In case of anomaly (damaged package, missing or deteriorated product), the customer must make reservations with the carrier and inform BOBINES within three (3) working days of receipt, by email at the following address: bonjour@bobinesbijoux.fr.
BOBINES cannot be held responsible in case of error in the delivery details provided by the customer.

ARTICLE 6 – RIGHT OF WITHDRAWAL
In accordance with the provisions of articles L221-18 and following of the Consumer Code, the customer has a period of fourteen (14) days from the receipt of the products to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided by law.
The customer must notify their decision to withdraw by an unambiguous statement, notably by email to the following address: bonjour@bobinesbijoux.fr.
The customer then has a period of fourteen (14) days from the notification of their withdrawal to return the products to BOBINES.
Products must be returned in their original condition, complete, unworn and unused, allowing for their re-marketing as new. Failing this, the customer's liability may be engaged in case of product depreciation.
Return shipping costs remain at the customer's expense.
BOBINES will refund all payments received (excluding additional costs resulting from a delivery method chosen by the customer), within fourteen (14) days from the recovery of the products or proof of their shipment.
The refund will be made using the same payment method as that used during the order.
In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for personalized products or products made according to the customer's specifications.

ARTICLE 7 – LEGAL GUARANTEES
The products supplied by BOBINES benefit by right and without additional payment, in accordance with legal provisions:
- from the legal guarantee of conformity (articles L217-3 et seq. of the Consumer Code), allowing the customer to obtain repair or replacement of the product in the event of a lack of conformity within a period of two (2) years from delivery of the goods;
- from the legal guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the customer to choose between cancellation of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.
Under the legal guarantee of conformity, the customer:
- has a period of two (2) years from the delivery of the goods to take action;
- can choose between repair or replacement of the product, subject to the cost conditions provided by law;
- is exempt from providing proof of the existence of the lack of conformity during the twenty-four (24) months following the delivery of the goods.
To assert their rights, the customer must inform BOBINES in writing of the non-conformity of the products or the existence of hidden defects.
Legal guarantees apply regardless of any commercial warranty that may be granted.

ARTICLE 8 – LIABILITY
BOBINES cannot be held responsible for damages resulting from improper use of the purchased product.

ARTICLE 9 – INTELLECTUAL PROPERTY
All elements present on the BOBINES website, including but not limited to, texts, images, photographs, visuals, graphics, logos, visual identity, content, as well as the concept and creations offered, are protected by intellectual property law and are the exclusive property of BOBINES.
Any reproduction, representation, modification, distribution, exploitation or use, total or partial, of these elements, by any process whatsoever and on any medium whatsoever, without prior written authorization from BOBINES, is strictly prohibited.
Any unauthorized use may lead to legal action in accordance with the provisions of the Intellectual Property Code.
The customer undertakes not to infringe, directly or indirectly, the intellectual property rights of BOBINES.

ARTICLE 10 – PERSONAL DATA
Personal data collected in the context of sales made on the site are processed by BOBINES, as data controller, in accordance with current regulations, particularly Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and the French Data Protection Act.
Data collected from the Customer is necessary for the processing and management of orders (including delivery, invoicing, after-sales service), as well as for customer relationship management.
Subject to the express agreement of the Customer, certain data may also be used for commercial prospecting purposes (newsletter, promotional offers).
Personal data may be transmitted to service providers involved in the execution of orders (including payment, delivery, or website hosting services), to the extent necessary for the performance of their duties.
Data is stored for a period strictly necessary for the purposes for which it was collected, in accordance with current regulations.
The Customer has, in accordance with applicable regulations, a right of access, rectification, erasure, opposition, limitation of processing and portability of their data. They can exercise these rights by contacting BOBINES at the following address: bonjour@bobinesbijoux.fr.
The Customer also has the right to lodge a complaint with the CNIL if they believe their rights are not respected.

ARTICLE 11 – MEDIATION
In accordance with articles L.611-1 et seq. of the Consumer Code, the Customer has the possibility to resort free of charge to a consumer mediator in case of a dispute with BOBINES regarding the execution or interpretation of these GTC.
Before any referral to the mediator, the Customer must send a preliminary written complaint to BOBINES, by email to bonjour@bobinesbijoux.fr or by mail to the address of the registered office. This complaint must precisely set out the dispute encountered.
In the absence of a satisfactory response or a response within 30 days of receipt of the complaint, the Customer may refer the matter to the competent mediator:

ARTICLE 12 – APPLICABLE LAW AND COMPETENT JURISDICTION
These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law.
In the event of a dispute relating to the interpretation, execution or validity of these GTC, the parties will first seek an amicable solution. Failing an amicable agreement, the dispute will be brought before the competent courts:
• for non-professional customers, in accordance with Article L. 211-4 of the Consumer Code, the dispute may be brought before the court of the consumer's place of residence or, at the consumer's choice, before the court of the product's delivery location;
• for professional customers, the dispute will be subject to the exclusive jurisdiction of the courts of the district of BOBINES's registered office.
